As you enjoy your wonderful new on-air look, please keep the
following in mind:
All
logos and phrases used (including ours) are the property of their
respective owners.
You
own and are licensed for the finished product located on the
physical “looks” media (disks tapes, etc.). We still own the rights to the intellectual material ON the
media. Lower3rd owns and retains all Master Artworks. They will remain in our possession and control permanently.
We do not ship master files out of house or allow any viewing
or manipulation of them by clients.
You
have a single station/company license to use this material.
This look cannot be used by, shared with, re-sold, given to
sister stations, etc. Lower3rd retains the rights to all graphics created and composited
by us. Client
suggestions for the improvement to our graphics become our property. We have the right to use them in our subsequent
looks, sales and promotions.
We retain the right to syndicate all of our “looks” to
any and every market who shall want them. We will however vary each client’s version of the look so
as to insure that no two looks will be exactly the same.
Randomly
selected samples of client graphics may be used in future
ads/promotions. A
testimonial quote may be requested from client as well for future
ads.
Lower3rd
would like to have an end credit in your shows.
We’ve already built a discount into our package pricing to
accommodate our asking of this
request. The show
“rollout” co-credit might read: “Graphics Design - W??? (your
company name or call letters) in partnership with Lower3rd Digital
Graphics”.
We
request being co-named for any graphical Style, and Image awards
(tied to our influence) the company/station submits to or wins.
We’d like to get a co-mention and share in the award.
We’d absorb our own expenses for our duplicate
award/statues. Because
you’ll share in the look’s final design, we can deem some
projects as collaborative co-efforts.
Delivered
graphics may vary slightly from those depicted in the Gallery due to
our commitment to avoid the “cookie-cutter” mass-produced line
of works. Like numbered
artwork, each execution of a design will be finished differently for
each client’s unique peace of mind.
Note:
Regardless of any variations, rest assured that you will receive the
approved version that reflects the changes you signed-off on.
No major variations will occur to this.
Though
many of these looks are “timeless”, we ask that you institute a
self-imposed time stamp on them. Variety is the spice of life, so
let’s change things up and retire each look about every 2 - 2.5
years. If you can’t
bring yourself to change the best look you’ve ever had, we’ll
understand.
Certain
procedures we use are
proprietary. We like to
treat them as if all of them were.
Client agrees not disclose or share our methods, procedures
and/or programming support materials with anyone outside of
necessary company operating personnel.
Any
client disagreeing with any portions of these disclaimers should
e-mail us with the provisions in question.
Modified disclaimers will be re-sent upon review.
We
reserve the right to modify, amend or replace entirely the content
of this website including these Disclosures/Disclaimers at any time,
and to determine whether and when, at our sole discretion, any such
changes apply to both existing or future clients.
